Headline: Qingdao Intermediate People Court used the Mechanism of Finding Foreign Law to Resolve Disputes between the countries along the Belt and Road.

Recently, our Civil Court and East China Law University’s foreign law Identification Research Center have been working together to resolve a dispute between countries along the belt and road in a timely and proper way.

A Russian trading company applied to our court for the recognition and enforcement of the foreign arbitration award between itself and an enterprise in Qingdao. During the trial of the case, the Qingdao enterprise considered that the validity of the arbitration agreement was questionable, and then raised defense. According to the law of China, we should judge the validity of the arbitration agreement according to the relevant laws of the place where the arbitration institution is located, that is, Russia.

Therefore, our court and Political Science And Law Research Center Of East China Law University worked together to find out the relevant Russian laws and hoped to solve the problem of the validity of arbitration agreement and the consistency of English and Russian versions of relevant laws. After the judge’s patient interpretation and mediation at court hearing, the two sides reached agreement at last. The Qingdao enterprise had fulfilled the agreement, and a transnational dispute had been properly resolved. Both parties expressed their appreciation for the fairness, professionalism and efficiency of Qingdao court, expressed their confidence in China’s justice and market prospects.

The mode of solving the application of foreign law in foreign-related cases by the cooperation between Courts and University think tanks has become more and more mature. When facing increasing number of transnational litigation cases, our Civil Courts have continuously enhanced their ability to handle disputes involving foreign countries through extraterritorial law cooperation mechanism, especially the countries along the belt and road, providing strong judicial protection for the development of export-oriented economy of China.
